Privacy protections for our consumers are fundamental to eBay. We want to make sure that our consumers benefit from technological advances that help them navigate eBay and find things they like – while making sure their privacy remains protected.
eBay has a global privacy philosophy with its users. We were the first Silicon Valley Tech firm to adopt Binding Corporate Rules. Under those rules, we follow the General Data Protection Regulation (GDPR) globally, regardless of the jurisdiction where a particular user resides. This means we have generally extended the rights GDPR affords to European Union (EU) residents to eBay users globally.
Harmonization and consistency of laws and regulations across the globe are imperative. Any U.S. Federal Privacy Framework should be designed to achieve an adequacy from the EU Commission.
The patchwork of privacy legislation developing across the United States—with each state adding its own nuances to the privacy landscape—adds unnecessary complexity and could result in inconsistent and sometimes frustrating user experiences. We need a preemptive federal law, enforced exclusively by a government agency (like the FTC) that is consistent with GDPR and the California Consumer Privacy Act (CCPA).
